BIR defers penalties for late submission of monthly sales report

CEBU CITY, July 26 (PIA) -- The Bureau of Internal Revenue (BIR) has deferred to October 8 or 10 this year the imposition of penalties for late submission of the required monthly sales report of taxpayers using cash register machines (CRMs), point of sales (POS), and other invoice or receipt-generating machines. 

BIR Deputy Commissioner Nelson M. Aspe of the Operations Group, and Deputy Commissioner Lilia C. Guillermo of the Information Systems Group issued the deferment on the imposition of penalties in thru a memorandum order (OPM-TAS-TSPMD No. 2012-05-02) issued on July 13, 2012 to revenue district offices and concerned chiefs of Large Taxpayer Service, and Taxpayer Service Sections. 

This is in response to the numerous requests for the extension in the submission of monthly sales report by taxpayers as covered under Memorandum Order No. 12-2012. 

Memorandum Order 12-2012 prescribes the guidelines and procedures in the implementation of electronic sales reporting as provided under Revenue Regulations No. 5-2005 as amended by Taxpayers Using CRM, POS and other invoice or receipt generating machines and for other purposes. 

The issuance of the order took effect January 2012, but for non-large taxpayers, the initial reporting for the months of January to June was on July 8 or 10, whichever is applicable. (PIA-Cebu with BIR PR)

DENR-7 requires LGUs’ endorsement for special tree cutting

CEBU CITY, July 26 (PIA) --- The Department of Environment and Natural Resources (DENR) 7 has required the Department of Public Works and Highways (DPWH) the endorsement of local government units (LGUs) and the Office of the Provincial Governor as a requirement in issuance of a cutting permit. 

Montejo said that the requirements include application letter, photographs of trees to be removed, sketch map showing the location of trees to be removed, endorsement of local government unit concerned, and environmental compliance certificate (ECC) and minutes of public consultation concerning the removal of trees. 

DPWH requested the DENR to cut trees that will be affected by the implementation of the widening of Natalio Bacalso Avenue, Naga-Carcar Section. 

DENR 7 Regional Executive Director Dr. Isabelo R.Montejo said, however, that his office have not yet received the endorsements from the concerned LGUs to support the application for a special tree cutting permit by DPWH. 

“We should consider the social acceptability component here and the communities should be consulted,” he said. 

Based on the inventory conducted by a joint team of four from DENR 7 and one from DPWH in May 11 and 16 last year, 155 trees with an aggregate volume of 192.77 cubic meters of different species will be affected. 

Of the 155, 25 are century old acacia trees (Samanea saman) with a diameter ranges from 92 centimeters to 226 centimeters. Also, out of 25 trees nine are considered hazardous, defective and need immediate attention. 

He further added that the said request was forwarded to DENR Central Office in Manila as the authority is vested upon the DENR Secretary as it involves century old trees with heritage significance to be cut down. 

“We endorsed the application to Manila as DENR Undersecretary Analiza Teh issued a memorandum last June 22 stating, among others, that all requests for tree cutting permits shall be properly endorsed to the Secretary thru the Forest Management Bureau, as well as the implementing guidelines of Presidential Decree 953 and Executive Order 23,” Montejo said. 

Further, Motejo said that “Removal of trees in urban areas can be through earth-balling or cutting, however, when establishing infrastructure projects, removal of the trees shall be the last option and the design of the projects shall complement the presence of existing vegetation”. 

“The application for the removal of trees causing obstruction to building construction and other infrastructure projects like road widening and road right of way shall be filed at the nearest DENR office,” Montejo added. 

“Heritage trees, those with historical and cultural significance as certified by the National Historical Institute or by other appropriate agencies, and landmark trees as certified by the concerned LGU shall be preserved, nurtured and applied with tree maintenance practices as necessary,” Motejo said.(RMN/HFG/PIA-7/DENR-7)
